Terms of Service · v1
Plain English first, then the full agreement. Use CHUD to learn, you own your work, you can cancel any time, and a few limits never come off.
The short version
Use CHUD to understand your work and to produce work you stand behind. You're responsible for what you turn in, and for following your school's rules about AI.
You keep ownership of what you put in and what comes out. We don't sell your data, we don't train on your conversations by default, and we don't run ads.
It's an AI. Check anything that matters — facts, numbers, citations, math — before you rely on it. It is not medical, legal, or financial advice.
Paid plans renew until you cancel, and cancelling takes the same number of taps as subscribing. No retention maze, no cancellation fee.
No matter the mode or setting, CHUD won't help with self-harm, weapons, drug synthesis, sexual content involving minors, or targeted harassment.
This summary is here to be readable, not to replace anything. The numbered sections below are the actual agreement.
These Terms of Service ("Terms") are a contract between you and SPARKk ("we", "us"), which operates CHUD (the "Service"). By creating an account or using the Service, you agree to them. If you don't agree, don't use the Service.
If you use CHUD on behalf of a school, district, or organization, you confirm you're authorized to accept these Terms for that organization, and "you" means that organization.
You must be at least 13 years old to use CHUD. If you're under 18, you may only use CHUD with the permission of a parent, guardian, or your school, and that adult agrees to these Terms with you.
CHUD is built for students, so conservative defaults apply to every account. Settings that relax tone or language are off by default and must be deliberately turned on. Some settings are unavailable to accounts identified as belonging to minors.
If we learn that an account belongs to someone under 13, we'll delete it and its data.
You're responsible for your account and for keeping your login secure. Don't share your account, and tell us promptly at the address below if you think someone else has access to it.
Keep your account information accurate — we use it to reach you about billing and about your account's security.
Use CHUD lawfully and decently. Specifically, don't use it to:
Some of these limits are enforced by the Service itself and cannot be disabled by any mode, persona, prompt, or setting.
CHUD is a study tool, and it is designed to teach rather than to ghostwrite. It will explain, work through problems with you, critique your drafts, and quiz you — and it will decline to produce work whose only purpose is to be passed off as yours.
Your school's rules govern. Policies differ enormously between schools, courses, and individual assignments, and it's on you to know what yours allows before you use CHUD on graded work. We can't and don't determine what's permitted in your class.
"Inputs" are what you send to CHUD — messages, files, photos, notes. "Outputs" are what CHUD sends back. As between you and us, you own your Inputs and, to the extent ownership is available, we assign to you our rights in the Outputs you receive.
You give us the limited licence we need to operate the Service — to store, process, transmit, and display your Inputs and Outputs so we can answer you, save your history, and provide features you ask for. That licence exists only to run the Service for you.
We do not train models on your conversations by default. If we ever offer a program where you can opt in to contribute data, it will be opt-in, clearly explained, and revocable.
Outputs are not unique to you. Another user asking a similar question may get a similar answer, so Outputs may not be protectable and we can't promise they're original. Check anything you intend to publish or submit.
You're responsible for your Inputs — including having the right to share them and to let us process them.
CHUD is an AI system and it makes mistakes. It can state something false with total confidence, misread a photo, get arithmetic wrong, or cite a source that doesn't say what it claims. Verify anything that matters before relying on it.
CHUD is not a professional. It does not provide medical, mental-health, legal, or financial advice, and nothing it says creates a professional relationship. For a real decision in any of those areas, talk to a qualified person.
CHUD is not a crisis service. If you're in danger or thinking about hurting yourself, contact the 988 Suicide & Crisis Lifeline (call or text 988 in the US), text HOME to 741741, or call your local emergency number.
CHUD offers a free tier and paid subscriptions. Prices, included usage, and what each plan unlocks are shown on the pricing page before you buy, and that page controls.
Refunds are handled case by case, and required by law in some places. If something went wrong — a duplicate charge, a plan that didn't work — email us and we'll sort it out.
This is a commitment, not just a description. We do not show advertising, we do not sell or rent personal information, and we do not design the product to manipulate you into spending.
That means no fake countdowns, no invented scarcity, no pre-checked upsells, no guilt-trip cancellation screens, and no burying the free option. If a feature only works by pressuring you, we cut the feature.
We're actively building CHUD, so features will change, improve, and occasionally be removed. If we remove something significant that you rely on, we'll give you reasonable notice where we can.
Some features are labeled beta or experimental. Those may be unstable or withdrawn, and we don't promise they'll keep working.
You can stop using CHUD and delete your account at any time from Settings. Deleting your account erases your account and the data tied to it.
We may suspend or terminate an account that breaks these Terms, that puts other users or the Service at risk, or where we're required to by law. Where it's appropriate and lawful, we'll tell you why and give you a chance to respond. If we terminate your account without cause, we'll refund the unused portion of any prepaid period.
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We don't warrant that the Service will be uninterrupted, error-free, or that Outputs will be correct.
Some jurisdictions don't allow certain disclaimers, so parts of this section may not apply to you. Nothing here limits rights you have under consumer protection law that can't be waived.
To the fullest extent permitted by law, neither we nor our suppliers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or lost goodwill, arising out of or relating to the Service.
Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or fifty US dollars.
These limits don't apply to liability that can't be limited by law — including, in many places, liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence.
If your use of the Service, your Inputs, or your breach of these Terms causes a third-party claim against us, you agree to defend and indemnify us against that claim and the reasonable costs of defending it. We'll tell you promptly about any such claim and let you control the defense, with our reasonable cooperation. This doesn't apply to the extent the claim arises from our own wrongdoing.
Talk to us first. Nearly everything is fixable by email, and we'd rather fix it than argue about it. Before starting formal proceedings, please contact us and give us thirty days to resolve the issue.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict-of-laws rules. Any dispute not resolved informally will be brought in the state or federal courts located in Pennsylvania, and we each consent to their jurisdiction.
If you're a consumer resident in a jurisdiction that guarantees you the right to bring proceedings locally or under your own law, this section doesn't take that right away.
We may update these Terms as the Service changes or the law requires. If a change materially affects your rights, we'll give you notice in the app or by email before it takes effect, and we'll update the version and effective date at the bottom of this page.
Continuing to use CHUD after a change takes effect means you accept the updated Terms. If you don't accept them, you can stop using the Service and cancel your plan.
These Terms, together with the Privacy Policy and any plan terms shown at purchase, are the entire agreement between us about the Service. If a provision is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver of it. You may not transfer these Terms without our consent; we may transfer them to an affiliate or in connection with a merger or sale of assets.
